Approver Drive Terms and Conditions

These Terms and Conditions apply to all services provided by Approver Drive (Pty) Ltd (“Approver Drive”).

By confirming a booking, the Client agrees to be bound by these Terms and Conditions.

 

1. Operating Hours & Surcharges

Office Hours

Approver Drive operates 24 hours a day, 7 days a week, 365 days a year.

We are contactable at all times via email, mobile phone, and WhatsApp to ensure continuous support and service delivery.

After Hours

Services rendered before 06:00 and after 20:00 will attract an after-hours surcharge.

Midnight Surcharge

A surcharge of 25% of the total booking value will apply to services rendered between 00:00 and 05:00.

 

2. Bookings, Pick-Ups and Waiting Time

Booking Information

Clients are responsible for providing complete and accurate booking information, including pick-up and drop-off locations, dates, times, passenger numbers, and luggage requirements.

Failure to provide accurate information may result in additional charges or service limitations.

Additional Pick-Up / Stops

Additional pick-ups or stops requested en route will be charged for and are subject to operational feasibility and confirmation.

Waiting Time

The first 15 minutes of waiting time is complimentary. Thereafter, waiting time will be charged per 15 minute increments or part thereof, including delays caused by the passenger.

Route Deviations

Any deviation from the originally confirmed route or destination may result in additional charges.

Airport Collections and Flight Monitoring

For airport collections, valid flight details must be provided at the time of booking. While flight delays will be monitored where possible, excessive waiting time may be charged accordingly.

 

3. Vehicle & Passenger Conditions

Maximum Passenger Capacity

Passenger numbers must not exceed the maximum capacity specified for the vehicle class. This is strictly enforced for safety, insurance, and compliance purposes.

Approver Drive reserves the right to refuse service where passenger capacity exceeds legal limits.

Luggage Capacity

Passengers are responsible for ensuring luggage requirements align with the selected vehicle class.

Excess luggage may require vehicle upgrade and additional charges.

Vehicle Substitution

In the event of mechanical failure, operational disruption, or unforeseen circumstances, Approver Drive reserves the right to provide an equivalent or upgraded vehicle at no additional cost.

Payment Policy

No cash payments will be permitted during and / or at termination of the service.

Damages

The Client and/or passenger shall be liable for any damage caused to the vehicle by themselves or any member of their party during the service. Cleaning or repair costs may be charged accordingly.

 

4. Use of Subcontractors

Operational Subcontracting

Approver Drive reserves the right to utilise approved subcontracted service providers to fulfil bookings where operationally required.

Service Standards

All subcontractors engaged by Approver Drive are required to meet company standards relating to vehicle condition, licensing, insurance, safety compliance, and service delivery.

Liability

Where subcontractors are utilised, Approver Drive remains responsible for overall service coordination; however, liability for operational incidents will be limited in accordance with these Terms & Conditions and applicable law.

Non-Circumvention

Clients may not directly engage, solicit, or contract any driver, subcontractor, or service provider introduced by Approver Drive without prior written consent.

 

5. Cancellations & Amendments

Cancellations

  • Tours and Chauffeur Drive services cancelled within 24 hours of the scheduled service time will incur a 100% cancellation fee.
  • Airport transfers and point-to-point services cancelled within 4 hours of the scheduled service time will incur a 100% cancellation fee.
  • No-shows will be charged at 100% of the booking value.

Amendments

All amendments are subject to availability and may result in rate adjustments or additional charges.

 

6. Force Majeure & Operational Disruptions

Approver Drive shall not be held liable for delays, cancellations, or service disruptions caused by events beyond its reasonable control, including but not limited to:

  • Weather conditions
  • Traffic congestion
  • Road closures
  • Civil unrest
  • Airline delays
  • Government restrictions
  • Mechanical breakdown beyond reasonable preventative maintenance

Approver Drive will make all reasonable efforts to mitigate disruption but does not guarantee journey time.

 

7. Billing & Commercial Terms

VAT

All rates quoted exclude VAT unless otherwise stated.

Rate Validity

Rates are subject to change with prior notice and may be adjusted in response to fuel price fluctuations, regulatory changes, or operational cost increases.

Corporate Credit Terms

Credit facilities are subject to approval. Approved accounts must adhere to agreed settlement terms.

Late Payments

Late payments may attract interest and/or administrative charges as permitted by law.

 

8. Limitation of Liability

Approver Drive’s liability is limited to the value of the booked service. Approver Drive shall not be liable for:

  • Indirect or consequential losses
  • Missed flights or appointments due to external factors
  • Loss or damage to passenger belongings unless caused by proven negligence
  • Passengers are responsible for their personal belongings.

 

9. Insurance

All vehicles utilised for services are comprehensively insured in accordance with South African transport regulations. Passenger liability insurance is maintained as required by law.

Insurance does not cover loss or damage to passenger personal belongings unless caused by proven gross negligence.

 

10. Booking and Confirmation Policy

  • Airport transfer rates are fixed zone prices. Parking fees, toll gates, fuel, and the first 15 minutes of waiting time are included unless otherwise stated.
  • Bookings may be made via our call centre or email.
  • Bookings are only confirmed once processed and dispatched by way of electronic confirmation.
  • Approver Drive reserves the right to refuse or cancel bookings at its discretion prior to dispatch.

 

11. Data Protection & Privacy

Approver Drive undertakes to take reasonable technical and organisational measures to protect client personal information in accordance with applicable South African data protection legislation (including POPIA).

Client information will be used solely for service delivery, billing, and operational communication purposes.

 

12. Acceptance of Terms

Confirmation of any booking with Approver Drive constitutes acceptance of these Terms & Conditions.
